1. Acceptance of Terms

By accessing or using the website at https://www.arivna.com ("Website", "Service", "Arivna"), creating an account, or registering any subdomain, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, Pricing Policy, and Cancellation/Refund Policy. If you do not agree to these terms, do not access or use this Service.

2. Eligibility & Account Registration

You must be at least 18 years old or possess legal parental/guardian authorization to form a legally binding contract.
You agree to provide true, accurate, current, and complete KYC information during registration (including your Full Legal Name, active Email Address, and Contact Mobile Number).
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Nature of Domain Lease & Ownership

Lease Right: The registration of a subdomain (e.g. yourname.arivna.com) grants the customer a non-exclusive, non-transferable, renewable license to configure DNS records for the paid subscription period (1 year).
Root Domain Ownership: The root domain arivna.com and all associated trademark, brand, and infrastructure assets remain the exclusive intellectual property of Arivna.
Reserved & System Names: Arivna reserves the right to restrict or reserve specific infrastructure names (e.g., www, admin, api, mail, support, billing, dns) to safeguard system stability.

4. Strict Acceptable Use Policy (Zero-Tolerance Abuse)

To protect our internet reputation, IP addresses, and community of developers, Arivna enforces a strict, zero-tolerance policy against malicious internet activity. You agree NOT to use any subdomain for:

Phishing & Fraud: Impersonating banks, financial institutions, cryptocurrency platforms, payment gateways, or known brands.
Malware & Exploits: Distributing trojans, spyware, ransomware, virus payloads, keyloggers, or malicious browser extensions.
Spam & Unsolicited Communication: Operating email relays for spam, high-volume scraping, or unsolicited bulk messaging.
Illegal Activities: Hosting content that violates the Information Technology Act, 2000 of India or applicable regional criminal statutes.
Infringement: Hosting pirated software, copyright-infringing media, or trademark counterfeits.

⚠️ Immediate Termination: Any subdomain identified or reported with evidence of engaging in prohibited activities will be suspended or permanently revoked immediately without prior notice and without refund.

5. Service Availability & SLA

Arivna utilizes Enterprise-grade Cloudflare infrastructure to deliver 99.9% uptime for global DNS resolution. However, we do not guarantee uninterrupted, error-free operation at all times. Scheduled infrastructure upgrades, upstream internet outages, or emergency security mitigations may occasionally impact service availability.

6. Payments, Renewals & Expiration

Subdomains are provisioned on an annual cycle (365 days).
To ensure continuous website availability, customers must renew their domain prior to the expiration date.
Expired subdomains enter a 7-day grace period, after which DNS routing is disabled and the subdomain becomes eligible for release or registration by another customer.

7. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Arivna, its operators, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption arising out of your use or inability to use the service. Our maximum cumulative liability for any claim shall not exceed the amount paid by you for the specific domain subscription during the preceding twelve months.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of India. Any legal action, suit, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts having jurisdiction in India.
